TrackDNA - DMCA / Copyright Policy

TrackDNA (“we,” “us,” or “our”) respects the intellectual property rights of others and expects all users, contributors, and partners to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we have adopted the following policy relating to copyright infringement and takedown procedures.
This policy applies to all content published on our website, in our digital magazine, print magazine, newsletters, social media, and any related platforms (collectively, the “Services”).
1. Reporting Copyright Infringement
If you believe that content on TrackDNA infringes upon your copyright, please submit a formal DMCA Takedown Notice to our designated representative at:

Your notice must include the following information to be considered valid under the DMCA:
- Identification of the copyrighted work you claim has been infringed (a URL or detailed description).
- Identification of the infringing material on our Services, including the exact URL where it appears.
- Your contact information, including your full legal name, address, telephone number, and email.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Without all six elements, we cannot process the request.
2. Upon Receiving a Valid DMCA Notice
Once we receive a complete and valid DMCA notice:
- The allegedly infringing content may be removed or disabled promptly.
- We may contact the contributor or user who posted the content.
- We may share portions of your notice (excluding personal contact info unless required by law) with the uploader.
TrackDNA may also terminate contributor or user accounts in cases of repeated infringement.
3. Counter-Notification Procedure
If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a DMCA Counter-Notification.

Your counter-notice must include:
- Identification of the material that was removed or disabled, and the location where it previously appeared.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal courts in your district (or the district where TrackDNA is located).
- Your physical or electronic signature.
Upon receiving a valid counter-notification:
- We may restore the content unless the original complainant files a court action within 10–14 business days.
4. Repeat Infringer Policy
TrackDNA may, at its discretion, suspend or terminate:
- User accounts
- Contributor privileges
- Access to the Services
for individuals who are found to be repeat copyright infringers.
5. Contributor and Photographer Responsibility
Contributors, writers, and photographers submitting content to TrackDNA agree to:
- Submit only original work
- Ensure they hold rights to all images, text, and media submitted
- Obtain any necessary permissions or releases
- Indemnify TrackDNA against copyright claims arising from their submissions
TrackDNA reserves the right to request proof of ownership or license at any time.
6. No Legal Advice
Nothing in this policy should be interpreted as legal advice. This policy is intended to comply with the requirements of the Digital Millennium Copyright Act and to provide a standard method for addressing copyright concerns.
7. Updates to This Policy
TrackDNA may update or modify this DMCA Policy from time to time. Updates will be reflected by the “Last updated” date above.
